NexBilt ("we", "us", "our") is committed to protecting your personal information. This Privacy Policy describes how we collect, use, disclose, store, and protect your information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) in Australia, and the Privacy Act 2020 and the Information Privacy Principles (IPPs) in New Zealand.

1. Data We Collect

  • Project information, photos, videos, documents, and site addresses you upload.
  • Account data: email, name, company name, region, and billing details.
  • Usage metrics (page visits, feature use, error logs) for improving the Service.
  • Communications you send to support.

2. How We Use Data

  • To generate scopes, quotes, SWMS, schedules, and reports.
  • To improve our AI accuracy and product performance.
  • To provide customer support, billing, and product updates.
  • To meet legal, regulatory, and tax obligations.

3. AI Processing & Cross-Border Data Transfer

  • To deliver our AI features, your inputs (text, photos, documents, videos) and outputs are processed by trusted third-party AI providers, including OpenAI (United States), Google (United States), and Perplexity (United States).
  • This means your data may be transferred to, stored on, or processed on servers located outside Australia and New Zealand, including in the United States, where privacy laws may differ from those in your country.
  • We disclose this transfer in accordance with Australian Privacy Principle 8 (cross-border disclosure of personal information) and New Zealand IPP 12 (disclosure outside New Zealand). By using the Service, you consent to this transfer.
  • We take reasonable steps to ensure these providers handle your information consistently with applicable privacy laws via their published data processing terms.
  • We do not sell your data to third parties or use it for advertising.

4. Storage & Security

  • Data is stored on secure cloud infrastructure with ISO-certified data centres.
  • All uploads and project files are private by default and protected by encryption in transit (TLS) and at rest.
  • Access is restricted via role-based permissions and multi-factor authentication for administrators.

5. Data Retention & Deletion

  • We retain your account data for as long as your account is active.
  • If you delete your account, we will permanently delete or de-identify your personal information within 30 days, except where retention is required by law (e.g., tax records) or for legitimate business reasons (e.g., dispute resolution).
  • You can request earlier deletion of specific data at any time by contacting info@nexbilt.com.au.

6. Data Breach Notification

  • In the event of a data breach likely to result in serious harm, we will notify affected users and the relevant regulator (the Office of the Australian Information Commissioner (OAIC) in Australia, and the Office of the Privacy Commissioner in New Zealand) within the timeframes required by law.

7. Your Rights

  • You have the right to access, correct, update, or request deletion of your personal information.
  • You may withdraw consent for optional processing at any time.

8. Children

  • The Service is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected such information, we will delete it promptly.

  • We use essential cookies to operate the Service and basic analytics cookies to improve user experience. You can control cookies through your browser settings.

10. Updates to this Policy

  • We may update this Privacy Policy from time to time. Material changes will be notified by email or in-app notice. The "Last updated" date at the top reflects the most recent revision.
